DULUTH, Minn. — A driver and a passenger accused of switching seats before they were pulled over near Duluth are both charged with drunken driving.

A Minnesota State Patrol trooper says a vehicle recently sped past him on Interstate 35 at 92 miles per hour. The trooper says that when he began pursuing the vehicle, he saw the man driving and the female passenger switch spots.

A criminal complaint says that when the pair was pulled over, 28-year-old Timothy Ryan denied having been behind the wheel and refused field sobriety tests. The complaint says the woman, 21-year-old Rakshita Evenson, had a blood alcohol level of nearly twice the legal limit.

KSTP-TV (http://bit.ly/HNcEb6 ) reports Ryan later told authorities he has DWI convictions from 2001, 2006 and 2011 in Ohio.
